AgID supervises accredited entities that provide trust services (digital signatures, certified electronic mail, SPID, document management and preservation), ensuring compliance with legislation and Agency guidelines. AgID also exerts supervision, verification, control,monitoring and sanctioning powers to ensure compliance with the provisions of the Digital Administration Code and any other legislation on technological innovation and the digitalisation of the Public Administration.

AgID monitors and controls compliance with the requirements and guidelines set out in the Three-Year Plan. Depending on the seriousness of the violation detected and the type of damage caused to users, AgID can impose administrative sanctions, which are paid by the monitored entities.

Supervision of qualified and accredited entities

 

The procedure used by AgID to supervise the qualified and accredited entities and the power to issue sanctions is described in the article 14-bis clause 2, lett. i) of legislation 7 March 2015, n.82

 

Surveillance of digital transition obligations

 

Article 18-bis of D.lgs 7 March, n.82 and other related amendments establish the procedures for notification, control and warning in relation to digital transition and the power to impose sanctions for non-compliance with digital transition obligations.

 

Digital Ombudsman

 

The Digital Ombudsman is available to citizens who wish to report potential violations of the Digital Administration Code (CAD) or other legislation related to digitalisation and innovation.

Reports on qualified and accredited trust services

If you have experienced management anomalies in the provision of SPID services, digital signatures, certified electronic mail, regulation-compliant storage, or alleged regulatory violations or irregularities on the part of digital service providers, you can report them to AgID using the appropriate application

 

To submit the report, the following information is required:

  • reference date of the alleged irregularity;
  • e-mail address of the reporting party;
  • provider involved in the report;
  • indication of the service (SPID, PEC, Qualified Trust Services, Registrars);
  • description of the alleged breach or irregularity;
  • facts and circumstances giving rise to the report;
  • documentation supporting the alleged breach.
